PORTABLE PROPERTIES

[21a middle] Gemarah: A “moving courtyard” (ie: a slave) does not acquire possessions for its owner.
R’ Rosner explaining R’ Zilberstein: A Father put a suitcase for his son in the baggage compartment under a city bus (like a movable courtyard) without paying, and told his son the bus number and when it would arrive for him to pick it up. [GM’ Babba Kama] “One who benefits without another losing” is not liable to pay. Even though one may not be held accountable for reimbursement, it does not ‘seem right’ to take advantage of the system.

D-E-ep Thoughts: The Torah specifically outlines for us how to live by the “letter of law.” However, there are many cases that come up in our lives where we have to be able to apply the ‘spirit of law’ as well. We should understand that G-d wants us not to try to circumvent punishments or try to find loopholes around laws. We should strive to live upright, righteous, and Holy lives free from any hints of sin.
