NULLIFYING ALLOWANCES

[3b top] Braisa: The positive Mitzvah of Yebum (marrying a deceased brother’s childless wife) does not apply when the resultant marriage would be Ervah (a forbidden relationship) [ie: A’s brother B marries A’s daughter. When B passes away without children, A would still not be allowed to marry his daughter for the sake of Yebum). [Normally a positive Mitzvah pushes aside a negative prohibition, but the, “You shall not take [her]” applies even in the case of Yebum.]

D-E-ep Thoughts: It is extremely important to be cautious of what is permitted and prohibited in Jewish law (especially when situations involve two conflicting commands). These are not just old rules to follow from a wise man long ago. The Torah is our lifeblood and the only reason for continued existence. We must never take the law into our own hands (just because something “seems”/”feels” right) and always consult our Rabbis if we have doubts/questions.
