[2b top] Gemarah: If a man who died was married to a woman that was found to have been unable to have children, the deceased’s brother is permitted to marry any of his brother’s co-wives (there is no Yebum connection). This is due to the fact that the original marriage may be deemed ineffective retroactively because we say it may be viewed as a “Mekach Ta’os” (an acquisition under false pretenses – due to the unknown fact the she could not bear children). Therefore, the remaining brother has no connection to the “wife” to prohibit any future marriages.
E’s Lesson: We should learn an important applicable lesson from this case regarding one’s intent for marriage. Our primary focus should be that of populating the world and spreading G-d’s Holiness. People who are focused on purely physical gratification, are missing the purpose for their existence and misusing their vehicles that they have graciously been given. May we always have the proper spiritual approach even when involved in extremely physically defining acts.
